These conditions are applicable to all sales concluded with CASA CLAUDINA. Therefore, the client acknowledges having read these general conditions of sale and undertakes to respect them. These conditions of sale are modifiable at any time, and the applicable conditions will be those in force at the date when the reservation is made.
Article 1 - RATE
The prices indicated are in Euros and include VAT applicable on the day of the reservation. The rates indicated on the website www.casa-claudina.com are the only contractual rates. Breakfasts and meals are not included in the price, however, you have the possibility of benefiting from on-site catering by contacting our catering partner whose contact details appear on the website: casa-claudina.com.
Standard fees and charges applicable specifically to Villa I for a maximum of 16 people which are already included in the rates indicated on the website www.casa-claudina.com :
Number of guests allowed at no additional cost : 8 guests included.
Amount added to the price of the night of the advertisement for each guest beyond the number of guests included : 15€ per additional guest.
Villa II for a maximum of 24 people (Villa + Quinta) is not affected by this price per person.
Article 2 - DURATION OF STAY
The client who signs this contract concluded for a fixed period may not under any circumstances claim any right to remain in the premises at the end of the stay.
Article 3 - RESERVATIONS AND CONCLUSION OF THE CONTRACT
All reservation requests must be confirmed via our website at the URL address: casa-claudina.com, or by email: [email protected], or by one of our partner OTAs (booking.com, airbnb.fr, abritel.fr...).
If the reservation is made by phone, we commit ourselves to confirming its acceptance by email.
The reservation will only be validated after our confirmation by email which has the value of a contract.
The booking request implies acceptance of these general terms and conditions of sale.
A deposit of approximately 30% of the total amount of the reservation will be requested and the balance will be paid 15 days before your arrival. The reservation will only be effective if it is guaranteed by the client, after payment of a deposit of 30%.
CASA CLAUDINA reserves the right to refuse any reservation in the event that payment by credit card is refused. Reservations made by bank transfer must be honoured within 72 hours. The bank details (RIB/IBAN) to be credited will be sent in a separate email. After this 72-hour period, reservations may be cancelled.
Article 4 - MEANS OF PAYMENT
Reservations, whatever their origin, will be payable in euros only. CASA CLAUDINA accepts the following credit cards: Visa, Mastercard, maestro and American Express. www.casa-claudina.com has a secure reservation system with SSL encryption that protects and encrypts all sensitive data transmitted at the time of reservation to prevent any disclosure to a third party. Payment is processed by Stripe.com via our website which is a third party payment solution, which accepts credit and debit card payments on this website. This is a secure and fast solution. At the time of registration of the reservation, an authorization to debit the credit card will be made for 30% (deposit) or 100% of the total amount of the stay depending on the date of arrival and corresponding to the balance 15 days before the arrival.
Article 5 - MODIFICATION AND CANCELLATION OF THE STAY
Any modification or cancellation of the reservation must be notified by email to [email protected]. The cancellation will be valid only after confirmation by email or by telephone of the owners. The client may cancel the reservation free of charge up to 7 days before arrival. The client will have to pay the total amount of the reservation if he cancels within 7 days before the arrival. In case of early departure during the stay, the price corresponding to the service initially booked remains entirely acquired by the owners.
Article 6 - INTERNAL RULES - CAUTION
All the rooms and the common rooms of the house are non-smoking.
It is forbidden to smoke, even with the window open, in the rooms.
In case of non-respect of the present rules or in case of material damage in the accommodation or common areas, you may have to pay up to 350€.
The 350€ deposit is paid on the spot, by cheque or in cash when the keys are handed over, and is returned on the day of your departure. Identification (passport or national identity card) may be required as part of the check-in process.
Rooms are available from 16:00 and must be vacated by 10:00 on the day of departure. The guest agrees and undertakes to use the villa with due care. Any behaviour contrary to good morals and public order will lead the management to ask the client to leave the villa without any compensation or refund if payment has already been made.
Rubbish should be placed in the rubbish containers outside the garden. The container for glass is located near the barbecue.
Please make sure to close the gates after each visit to avoid intrusion by stray dogs.
The swimming pool is cleaned every morning between 06h30 and 07h30, if you do not wish to benefit from this free service, please let us know on arrival or by e-mail.
Article 7 - CANCELLATION BY THE OWNER
When, before the beginning of the stay, the owner cancels the stay, for reasons beyond their control or in case of force majeure (illness, death, climatic events, deterioration of the premises, breach of security of the clients...), they must inform the client as soon as possible by telephone or e-mail.
The client, without prejudice to any recourse for compensation for any damage suffered, will be reimbursed immediately for the sums paid.
Force majeure is any event external to the parties which is both unforeseeable and insurmountable and which prevents either the client or the establishment from fulfilling all or part of the obligations set out in the contract. Force majeure or fortuitous event shall be deemed to be those usually recognised by the jurisprudence of the Portuguese Courts and Tribunals. Each party shall not be liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising from it.
Article 8 - OPTIONAL
possibility of using the heated swimming pool all year round in the large pool (Package 250 Euros / week). It is advisable to inform Casa Claudina at least 72 hours before the date of arrival of the client so that the heat pump of the swimming pool works long enough to allow an ideal temperature.
Article 9 - Inside the house as well as outside (swimming pool), children are under the full responsibility of their parents.
Article 10 - ARRIVAL
The client must arrive on the day specified at the time of booking between 4pm and 10pm, when the villa is available. In case of late or delayed arrival, the client must inform Casa Claudina by e-mail or telephone. Under no circumstances may the guest use the villa before 4pm on the day of booking unless otherwise instructed by the owner. A set of keys to the property will be given to the guest on arrival. In the event of damage or loss of any of the keys or remote controls provided, a flat-rate compensation of 20€ per key and 50€ per remote control will be requested. The set of keys entrusted to you must be returned on your departure.
Article 11 - DEPARTURE
The time of departure from the villa is fixed at 10:00 am at the latest, unless the Casa Claudina establishment authorises you to exceed this time.
Article 12 - INTERNET
Casa Claudina offers a very high speed access with fibre optic technology in WI-FI 2,4Ghz and 5Ghz. The user customer undertakes to ensure that the computer resources made available to him/her are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright, by a neighbouring right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Book I and II of the Intellectual Property Code when such authorisation is required.
Article 13 - PETS
Small pets are allowed with the prior agreement of Casa Claudina. In case of departure of a customer motivated by the refusal of his animal, no refund can be considered.
Casa Claudina limits the number of pets in their establishment.
The animals admitted in the establishment are under the entire responsibility of their owner. Any damage or harm they may cause to property or persons may be the subject of a claim for compensation or legal proceedings.
Article 14 - LIABILITY
Casa Claudina declines all responsibility in the event of theft, loss or damage to the effects belonging to the clients during their stay. The client will be held responsible for any damage, deterioration, or vandalism that may occur due to the occupation of the premises and/or due to the participants and/or the personnel under their responsibility, as well as to the movable, decorative, and immovable property belonging or not belonging to the owner of the Casa Claudina villa. Therefore, Casa Claudina may ask the client to leave the establishment without any compensation or reimbursement of the stay in progress, and to reimburse the damage caused by these acts.
Article 15 - CAPACITY
The present contract is established for a precise number of persons indicated at the time of the reservation. If the number of guests exceeds this number, the owners are entitled to refuse additional guests.
Article 16 - APPLICABLE LAW
The present general conditions of sale are governed by Portuguese and European law. This applies to both substantive and formal rules. Any dispute will be under the exclusive jurisdiction of the Portuguese courts. Do not hesitate to contact us for any further information.
Article 17 - MODIFICATION OF THE CONDITIONS OF SALE
The present conditions of sale may be modified at any time and without prior notice. Acceptance of and compliance with these terms and conditions of sale are deemed to have been acquired on the booking request.
Non-compliance with the general conditions of sale and the instructions for good manners may be considered as a breach of contract at the initiative of the client. In case of early departure of the client, no refund can be considered.
